Separate return shipping enables automatic processing of contracts for Minol Messtechnik. Otherwise, the contract may not be correctly assigned.

Minol Messtechnik believes this contract fully meets the requirements of Article 28 of the GDPR (General Data Protection Regulation) – Data Processors – for both data controllers and service providers to protect data subjects. Since Article 28 of the GDPR explicitly requires such an agreement, the absence of one can be sanctioned by a supervisory authority with the fines specified in Article 83(4) of the GDPR.

A data processing agreement (DPA) must be concluded between the contracting parties where the scenario described in Article 28 of the GDPR – data processor – applies. This means that a controller transfers personal data to a service provider for processing. The transfer to Minol Messtechnik can occur, on the one hand, through companies/individuals commissioned by homeowners (or homeowner associations). In this case, a DPA must be concluded between these companies/individuals and Minol Messtechnik. On the other hand, the transfer of personal data can occur directly from building/homeowners to Minol Messtechnik. In this case, a DPA must be concluded between the building/homeowners and Minol Messtechnik.

The following types of data are regularly processed:

• Address and registration data of the users / residents in the client's buildings as well as functional and/or consumption data of the measuring devices in user units.
• The data processing affects the users and/or residents in the client's buildings and the client's and contractor's employees.

Contracts concluded under the previously applicable German Federal Data Protection Act (BDSG) (in particular Section 11) are not invalid. However, these do not fully cover the requirements of the EU General Data Protection Regulation (GDPR). References and incorporations from the previous law can also lead to misunderstandings. A contract in accordance with Article 28 of the GDPR is definitely the better solution.
