Legal framework for water meters in the housing industry

The use of water meters in Germany is clearly regulated and subject to several legal requirements. The Heating Costs Ordinance (HKVO) obligates landlords to bill heating and hot water costs based on consumption. Since December 2021, newly installed water meters must also be remotely readable. Existing devices must be retrofitted accordingly by the end of 2026. The Measurement and Calibration Ordinance (MessEV) stipulates that water meters must be inspected and calibrated at specified intervals to ensure measurement accuracy. Furthermore, the Operating Costs Ordinance (§ 2 BetrKV) generally allows the costs for acquisition, maintenance, and calibration of water meters to be passed on to tenants.

Implementation of the current heating cost regulations

According to the Heating Costs Ordinance, heating costs in buildings must be billed based on consumption. Since the 2021 amendment to the Heating Costs Ordinance, the following applies:

  • Newly installed water meters must be remotely readable.
  • Existing devices must be retrofitted by the end of 2026.
  • From 2027 onwards, only remotely readable systems will be permitted.

Landlords and property managers must therefore switch to electronic, remotely readable water meters by the end of 2026 to comply with legal deadlines and benefit from digital advantages. Remotely readable water meters are the basis for fair, efficient, and future-proof heating cost billing.
